On July 8th, 2016 the Puerto Rico Department of Health, by executive order of Puerto Rico Governor Alejandro Garcia Padilla, Puerto Rico enacted, for the first time, rules regulating the Medical Marijuana Business on the island. Now 25 states have enacted legislation that allow for regulated Medical Marijuana use. Those include New York, Connecticut, Massachusetts and of course Puerto Rico. Massachusetts has on the ballot for 2016 a provision for recreational marijuana legislation. Florida is one of these states that has, on the ballot, legislation to allow for medical marijuana in the state. If passed it would allow for widespread use of marijuana for medical purposes. Marijuana or Cannabis, is a Schedule I drug, which means that it is still illegal and the use, trafficking or transportation and distribution across state lines is strictly prohibited by federal law.
This causes a complicated dilemma where Federal Law prohibits Marijuana or Cannabis and state law allows it (in the states where it is legal). For those interested in going into the medical marijuana or Cannabis, business, where legal, there are many considerations that need to be addressed. Medical Marijuana law is different in every state. There are no uniform codes or model regulations that serves as a guide, so each state decides what to implement and what to include in their medical marijuana law or regulation. These regulations are usually very detailed and complex often spanning hundreds of pages. The checks and balances of these medical marijuana laws are put in place to provide safety and control for each and every state that has legalized medical marijuana or cannabis.
